Determinate Versus Indeterminate Sentencing Policies

Indeterminate sentencing laws allow judges to give convicted felons a window of time rather a specific sentence length. With indeterminate sentencing, the judge provides a minimum and a maximum but defers authority regarding when a prisoner is released (or when probation ends) to other members of the criminal justice system such as parole board members and probation officers. Determinate sentencing is just the opposite: a procedure in which the trial judge does sentence an offender to a specific length of time. Both determinate and indeterminate sentencing have been commonly practiced in the United States, and each of these policies has strengths and drawbacks. While indeterminate sentencing can be helpful in cases where an inmate shows certain signs of rehabilitation, determinate sentencing can be deemed more fair overall.

The wolf in Grimm’s “Red Riding Hood” dons the disguise of Red Riding Hood’s grandmother in order to eat the girl after he has already eaten the grandmother. In The Ballad of Mulan, the girl dons the disguise of a man to fight in the Chinese Army. In all three cases, disguise is used to deceive, though the intention would not seem to be malicious in every case. Elon Musk is the CEO of Tesla and is a popular leader in the EV space. He is active on Twitter but has made some controversial tweets in the past. One came when he stated that he was going to take Tesla private at $420 per share (an inside joke later revealed to be made for his much younger girlfriend at the time Ms. Grimes). Another came when he called Thailand cave diving hero Vern Unsworth “pedo guy” and was subsequently sued for defamation. Another came recently when Musk said that “the coronavirus panic is dumb” (Stewart, 2020). Musk tends to present information in cavalier ways, often trying to appear humorous to a younger generation of stakeholders who tend to idolize him.
