Learning is a complex process by which an individual acquires and modifies their knowledge, behaviors, attitudes, and skills through study, instruction or experience. Theories provide a framework for understanding how learning occurs and the factors that influence its effectiveness. Learning theories are complex and comprehensive principles that explain how individual learn, develop, and progress (Rosser-Majors, 2017). They acknowledge that human beings learn differently and attempt to contextualize the learning process. Four of the most common learning theories are behaviorism, constructivism, cognitivism, and humanism. This text analyzes the learning process as portrayed by these four theories, the ideologies within each theory, and evidence-based application of learning theory to enhance learning.

Deception is at the core of counterintelligence: yet, it is a problematic core because of the corruption associated with deception in ethical systems. Mattox (2002), for example, observed that the practice of deception “is subject to limitations imposed by the demands of morality” (4). Unfortunately, morality within the realm of counterintelligence is often the first casualty, as history shows (Valentine 2016). The official beginnings of counterintelligence under the leadership of James Jesus Angleton have illustrated the extent to which the art of deception can create problems within the intelligence community (Morley 2017, 69). Within this community itself there is no standard ethical framework applied (Bailey and Galich 2012, 77). A defendant that has successfully been prosecuted and then found guilty will have their sentence determined and read out by a judge at the sentencing hearing. The sentencing hearing can only take place after the criminal conviction. During the sentencing hearing, the judge will have to decide on a sentence or a punishment based on the maximum and minimum sentences for the particular crime, as stipulated in the penal code. While all this sounds straightforward, there have been many cases recorded of discrimination and disparity in sentencing (Spohn, 2008).
With regards to sentencing, a disparity exists in two ways – when offenders who are different get the same punishment, and when similar offenders get different punishments.
