9. Missouri v. Frye - Docket No. 10-444 -- The question is can a defendant who validly pleads guilty successfully assert a claim of ineffective assistance of counsel by alleging instead that, but for counsel's error in failing to communicate a plea offer, he would have pleaded guilty with more favorable terms?
10. Howes, Warden v. Fields - Docket No., 10-680 -- The question is whether a prisoner is always in custody for purposes of Miranda any time that prisoner is isolated from the general prison population and questioned about conduct occurring outside the prison regardless of the surrounding circumstances.
There are going to be a lot of very interesting cases heard by the Supreme Court in the upcoming term starting in October. It will be particularly interesting to see the decision in United States v. Jones - Docket No., 10-1259 and Howes, Warden v. Fields - Docket No., 10-680 because both have to do with procedures that are used by law enforcement agencies that could change the ways that things are done.
