The Declaration of Independence, written in 1776, asserted that “all men are created equal.”[endnoteRef:2] It was an Enlightenment notion: Thomas Paine, an avid follower of the Enlightenment Movement in Europe, had written the Rights of Man to support and promote the ideas of the philosophical revolution that had gotten underway decades prior with Rousseau’s Social Contract and the latter’s pursuit of naturalism in opposition to the Old World values, virtues and order.[endnoteRef:3] The problem that occurred in America was that the Founding Fathers were not of the same mind as Thomas Paine, though they readily used his words and ideas in their Declaration of Independence. The responsibility of the law in preventing harm to oneself and upholding social morals varies from state to state. For example, in parts of Nevada, prostitution is legal; in other parts, it is not. The same goes for drug use. In some states, like Colorado, marijuana use has been legalized. In other states, it is still illegal and even under federal law it is illegal. Thus, in a democracy, the people are ultimately the ones to determine what their laws will be. However, there are definitely organizations that lobby for certain laws to be passed. For instance, prior to Prohibition, there were organizations that lobbied to have alcohol banned and eventually their voices were heard at the federal level.

This literature review first looks at the history if intelligence oversight (IO) and then explains the current problem it faces in terms of ethics and the arrival of the Digital Age, which has complicated the matter. It next synthesizes the literature on what the various ethical theories are and how this further complicates the issue of IO. Finally, it discusses research on the fundamentals of ethics and gives recommendations for future research.
History of IO
The history of IO begins with the purpose for which it was established, which was to safeguard the privacy and rights of U.S. persons while enabling the Department of Defense to carry out its intelligence functions most effectively (Ford 2006, 721).
